SECURITY COUNCIL EXPANDS MANDATE OF UN MISSION TO INCLUDE DARFUR

ADOPTING RESOLUTION 1706 BY VOTE OF 12IN FAVOUR, WITH 3 ABSTAINING

Invites Consent of Sudanese Government Authorized Use of ' All Necessary Means ' to Protect United Nations Personnel Civilians under Threat of Physical Violence

The Security Council decided this moming to expand the mandate of the United Nations Missions in the Sudan (UNMMIS) to include its deployment to Darfor, without prejudice to its existing mandate and operations, in order to support the early and effective implementation of Darfur Peace Agreement.

As it adopted resolution 1706 (2006) by a vote of 12 in fever with 3 abstentions (China, Qatar, Russian Federation), the Council invited the consent of the Sudanese Government of National Unity for that deployment, and called on Member States to ensure an expeditious deployment, and called on Member States to rapid deployment of addition capability to enable UNMIS to deploy in Darfur.

Acting under Chapter VII of the United Nations Charter ,the Council authorized UNMIS to use all necessary means as it deemed within its capabilities : to protect United Nations personnel , facilities , installations and equipment ; to ensure the security and freedom of movement of United Nations personnel , humanitarian workers , assessment and evaluation commission personnel ; to prevent disruption of the implementation of the Darfur Peace Agreement by armed groups , without prejudice to the responsibility of the Government of the Sudan; to protect civilians under threat of physical violence ; and seize or collect arms or related material whose presence in Darfur was in violation of the Agreement and appropriate.

The Council decided also that the mandate of UNMIS would be , among other things, to support implementation of the Darfur Peace Agreement and the N'djamena Agreement on Humanitarian Cease-fire on the conflict in Darfur , including by: monitoring and verifying the implementation by the parties to those agreements; observing and monitoring movement of armed groups and redeployment of forces in areas of UNMIS deployment by ground and aerial Commission ; monitoring transborder activities of armed groups along the Sudanese borders with Chad and the Central African Republic ; and ensuring an adequate human rights and gender presents , capacity and expertise within the Mission to carry out Human rights promotion, civilian protection and monitoring activities , including particular attention to the needs of women and children.

In a relation provision of the text, the Council decided further that the mandate of UNMIS in Darfur would also include assisting in international efforts to improve the security situation in the neighboring regions along the borders between the Sudan and Chad and between the Sudan and the Central African Republic. It requested that the Security-General and the Governments of Chad and Central African Republic conclude status –of-forces agreements as soon as possible , taking into consideration General Assembly resolution 58/82 on the scope of legal protection under the Convention on the safety of United Nations and Associated Personnel. Pending the conclusion of such an agreement with either country , the model status-of-forces agreement dated 9 October 1990 ( document A/45/594) would apply provisionally with respect to UNMIS forces operating in that country

The Council decided also that UNMIS would be strengthened by up to 17,300 military
personnel and by an appropriate civilian component including up to 3,300 civilian police personnel and up to 16 formed Police Units. It expressed its determination to keep the mission's strength and structure under regular review, taking into account the evaluation of the situation on the ground.

By further terms of the text, the Council requested the Secretary-General to consult jointly with the African Union, in close and continuing consultation with the parties to the Darfur Peace Agreement, including the Government of National Unity, on a plan and timetable for a transition from the African Mission in the Sudan to a United Nations operation in Darfur.

الترجمة :

مجلس الأمن

دعوة الحكومة السودانية للموافقة ، باستخدام سلطتها مع ( كل السُبل الضرورية ) لحماية أعضاء بعثة الأمم المتحدة والمدنيين تحت ضغط العدوان الجسدي .

قرر مجلس الأمن هذا الصباح تمديد التفويض لبعثة الأمم المتحدة في السودان وتشمل نشر قواتها في دار فور بدون التعرض لبعثتها الحالية وعملياتها ، بهدف الدعم والتنفيذ الفعال لاتفاق دار فور للسلام .

وباعتمادها القرار (1706 ) 2006 بتصويت (12) مع القرار وامتناع (3) عن التصويت ( الصين و قطر وروسيا الاتحادية ) ، يدعو المجلس موافقة حكومة السودان الموحدة لنشر تلك القوات ودعوة أعضاء الدول بالدعم السريع لتلك القوات. وترجو من السكرتير العام التنظيم السريع لنشر قوات إضافية يمكنها دعم قوات الأمم المتحدة في دار فور .

بالاستناد للفصل السابع من قانون الأمم المتحدة ، يخول المجلس لقوات الأمم المتحدة استخدام الوسائل التي تراها ضرورية من خلال قدراتها ، لحماية أعضاء بعثة الأمم المتحدة ، وتسهيلاتها ، والتجهيزات والمعدات لتأكيد الحماية وحرية الحركة لأعضاء بعثة الأمم المتحدة ، والعاملين في الخدمات الإنسانية ، وحماية ودعم مهامهم ومنع خرق اتفاق دار فور بواسطة المجموعات المُسلحة ، دون الإخلال بمسئوليات الحكومة السودانية في حماية المدنيين تحت ضغوط الاعتداء آت عليهم ، وانتـزاع وجمع الأسلحة وكل المواد ذات الصلة التي يكون وجودها بمثابة خرق للاتفاقات الموقعة في دار فور ، وكل المقاييس التي تضمنها القرار 1556 ، والقضاء على تلك المواد والأسلحة وفق ما يكون مناسباً .

وقرر المجلس أيضاً تفويض القوات سيكون ضمن الدعم لتنفيذ اتفاق دار فور للسلام ، واتفاق انجمينا لوقف القتال إنسانياً في إطار تعقيد مشكلة دار فور ، ويحوي ذلك المراقبة والتدقيق على كل أدوار الجهات الموقعة على تلك الاتفاقات ، ومراقبة لكل تحركات المجموعات المسلحة ونزع أسلحتها في مناطق قوات الأمم المتحدة ، أرضاً وجواً ، والتحقق من الانتهاكات للاتفاقات وتقديم تقارير للجنة وقف إطلاق النار ، ومراقبة نشاطات مناطق التداخل الحدودي للمجموعات المسلحة على كل الحدود السودانية مع تشاد وأفريقيا الوسطى ، والتأكيد على مراعاة حقوق الإنسان والاختلاف الجندري ، والقدرة على اختبار إمكانية البعثة للقيام بترفيع المهام الإنسانية وحماية المدنيين ومراقبة النشاطات وخاصة مراعاة احتياجات النساء والأطفال .

بالرجوع للنص ، قرر المجلس أن تكون من مهام القوات الأممية دعم الجهود الدولية لتطوير الأحوال الأمنية في الأقاليم المجاورة ، وعند الحدود بين السودان وتشاد والسودان وأفريقيا الوسطى . وطلبت من الأمين العام مع الحكومة التشادية و حكومة أفريقيا الوسطى تضمين اتفاقات وضع القوات بالسرعة اللازمة ، آخذين في الاعتبار قرار الجمعية العامة رقم 58/82 في إطار الحماية القانونية لمستخدمي القوات الأممية . ويتبع ملخص الاتفاقية الخاصة لكل دولة حول نظم وضع القوات وفق اتفاق 9 أكتوبر 1990 م ( مستند / أ / 45/ 594 ) الذي ينطبق في كل الأحوال على قوات الأمم المتحدة وعملياتها داخل الدولة .

وقرر المجلس دعم قوات الأمم المتحدة بعدد يصل إلى 17300 جندي ووحدات مدنية تحوي 3300 من قوات البوليس المدني ، وعدد يصل إلى 16 وحدة بوليسية . تلك لدعم المهمة وتقويتها مع التطوير الدائم وفق الحالة على أرض الواقع .
إضافة على النص ، يرجو المجلس من الأمين العام مع الإتحاد الأفريقي في الاستمرار بالتشاور مع كل أطراف اتفاق دار فور للسلام ، ويشمل حكومة السودان ، مع الخطط و الجدول الزمني لنقل المهام من القوات الأفريقية إلى قوات الأمم المتحدة في دار فور .

أيد القرار كل من ( الأرجنتين ، الدنمرك ، فرنسا ، غانا ، اليونان ، سلوفاكيا ، المملكة المتحدة ، والجمهورية المتحدة لتنـزانيا ، والولايات المتحدة ) .
